Attorney Emmett Robinson’s practice focuses on federal- and state-court appeals as well as major-motion briefing at the trial-court level. Commercial and other Civil Litigation

Emmett handles civil appeals in a wide variety of matters for both business and individual clients. He likewise has extensive experience as a dispositive-motions attorney, drafting trial-court briefs that result in out-and-out victories or favorable settlements for his clients. He has drafted major trial-court and appellate briefs—including primary appellate briefs, motions to dismiss, motions for judgment on the pleadings, motions for summary judgment, and motions for reconsideration—in qui tam actions, consumer class actions, and actions alleging statutory violations, in actions involving allegations of unfair competition, breach of contract, tortious interference with business, and securities fraud, and in many other matters.

Criminal Appeals and Collateral Attacks

Emmett also maintains an active criminal defense practice, representing clients in state and federal court in both direct appeals and collateral attacks. As a trial-court clerk, he spent significant time reviewing motions for writs of habeas corpus and petitions for post-conviction relief under 18 U.S.C. § 2255 and drafted court opinions regarding the same. Likewise, as a state-supreme-court clerk, he was charged with assessing hundreds of petitions for review of criminal convictions on direct appeal. Emmett offers criminal-law services including:

Supreme Court Litigation and Extraordinary Writs

Emmett has litigated before the United States Supreme Court and Ohio Supreme Court. Recently, he was part of a three-lawyer team that sought and successfully obtained a writ of certiorari from the United States Supreme Court in Gamble v. United States (the Supreme Court receives approximately 7,500 "cert" petitions each year and, of those 7,500 cases, agrees to hear argument in roughly 80). Emmett was the sole author of the reply brief in support of Mr. Gamble’s petition for certiorari. An outstanding legal writer and analyst, Emmett offers services in drafting Supreme Court petitions for writs of certiorari (known as memoranda in support of jurisdiction in the Ohio Supreme Court), merits briefs, and amicus curiae briefs. Emmett also has experience with extraordinary writs, including writs of prohibition, writs of mandamus, and writs of coram nobis.
